Terms of Service

1. About these terms

Muso is an app that creates original songs as gifts. You describe someone you care about and an occasion, and Muso writes and records a song for them. These terms are the agreement between you and Muso ("we", "us") covering the Muso app, the share pages at heymuso.com, and everything you make with them (together, the "Service"). By using the Service you accept these terms. If you do not accept them, please do not use the Service.

2. Who can use Muso

You must be at least 13 years old, and old enough to hold an Apple ID in your country. If you are under the age of majority where you live, you may only use Muso with the involvement of a parent or guardian, who agrees to these terms on your behalf. You are responsible for everything that happens under your account.

3. Your account

You sign in with an email address and password, or with Sign in with Apple. Keep your credentials secure, and tell us promptly if you believe someone else has used your account. You may delete your account at any time from within the app; see our Privacy Policy for what happens to your data when you do.

4. Credits, subscriptions and payments

Creating a song costs credits. Credits arrive in three ways: a small number free when you start, packs you buy, and monthly allocations included with a subscription. All purchases are made through Apple's In-App Purchase system, so we never see or handle your card details.

  • Subscriptions renew automatically until you cancel. Your Apple ID is charged at confirmation of purchase and again at each renewal, at the price shown at the time you subscribed.
  • Cancel any time in your Apple ID settings, at least 24 hours before the current period ends. Cancelling stops future renewals; it does not shorten the period you have already paid for.
  • Credits are not money. They have no cash value, cannot be transferred or exchanged, and are not refundable except where the law requires it. Credits included with a subscription may expire at the end of each billing period.
  • Refunds are handled by Apple, under the App Store's policies. We cannot issue App Store refunds directly, though you are welcome to contact us if something has gone wrong.

We may change prices for future purchases and renewals. Where we do, you will be told in advance and can cancel before the change takes effect.

5. How songs are made

When you create a song, the details you provide are sent to third-party AI providers who generate the lyrics and audio on our behalf. That includes your description of the recipient and occasion, any lyrics you write, and the style you choose. Generation is automated. Nobody at Muso reads your gift details as part of making a song.

6. Rights in the songs you create

The songs you create are yours to use, including commercially. We claim no ownership of them. You may play them, share them, give them away, publish them, and use them in commercial projects, subject to these terms and to your account being in good standing.

Two honest limits you should understand before relying on a song commercially:

  • We cannot promise a song is unique. AI models can produce similar output for similar requests. Another user with a similar idea may receive something that resembles yours.
  • We cannot promise a song is protected by copyright. In many countries the copyright status of material generated by AI is unsettled, and works without sufficient human authorship may not be protectable at all. If a song matters commercially, take your own legal advice.

You keep ownership of anything you supply, such as the lyrics you write and the details you provide. By using the Service you give us permission to store and process that material to run Muso: to generate your song, deliver it to you, and host it for anyone you share it with.

7. Sharing and gifting

Songs are private until you choose to share them. When you do, we create a link to a page for that song, which anyone holding the link can open. Treat a share link as public: anyone it is forwarded to can reach it. You can unpublish a song at any time, though copies already downloaded stay with whoever downloaded them.

What a share page displays may change as Muso develops. Share a link only with people you are comfortable having access to it.

8. Acceptable use

Do not use Muso to create or share anything that:

  • infringes anyone's copyright, trademark, or other rights;
  • imitates a real artist's voice or identity, or is presented as their work;
  • harasses, threatens, defames, or sexualises anyone, or targets a real person without their knowledge in a way that would distress them;
  • is hateful toward people on the basis of race, ethnicity, religion, disability, sex, gender, sexual orientation, or similar characteristics;
  • is unlawful, or promotes serious harm.

Also do not attempt to break, overload, or reverse-engineer the Service, evade credit limits or usage caps, use automated means to create songs at scale, or resell access to Muso itself.

9. Availability

We are a small team and Muso depends on third-party services. We may change, suspend, or discontinue parts of the Service, and we do not promise uninterrupted availability. If we discontinue Muso entirely, we will give reasonable notice and a period in which to download your songs.

10. Termination

You may stop using Muso and delete your account at any time. We may suspend or terminate an account that breaches these terms, that is used to abuse the Service, or where we are required to by law. Where it is reasonable to do so, we will tell you why and give you a chance to respond.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that generated songs will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty US dollars. Nothing here limits liability that cannot be limited by law.

13. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and costs (including reasonable legal fees) arising from your use of the Service, from material you submit, or from your breach of these terms.

14. Governing law

These terms are governed by the laws of Singapore, without regard to conflict-of-law rules, and the courts of Singapore have exclusive jurisdiction, except that you may bring a claim in your local courts where consumer law gives you that right.

15. Changes to these terms

We may update these terms as Muso changes. If a change materially affects your rights, we will give reasonable notice in the app or by email before it takes effect. Continuing to use the Service after that means you accept the updated terms.

16. Apple App Store

Muso is distributed through the Apple App Store, and the following applies to that version of the app:

  • These terms are between you and Muso only, not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing claims relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims.
  • Apple is not responsible for investigating, defending, or resolving any third-party claim that the app infringes intellectual property rights.
  • You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
